The trial of the ''conspiracy 8" group in chicwo, for their
activity i n that city duringthe Democratic National Convention in
1968, has continued, 8s one of the eight.defendants has sald, t o re-
semble a three-ring circus with Judge Julius J. Hoffman as ri-ter.
Duringthe past week, the court was recessed for three days t o
pennit Defense Attorney UilUem M. Kunstler t o argue in a Boston court
on Monday, 6 October; and little appears t o have been accomplished
during this second week of the trial, though Judge Hofnpan did rule
that round-the-clock surveillance, which occuxred during the Convention
demonstrations, did not vtolate the defendants' ri@t t o privacy, as
vas claimed by the Defense. In derqing a defense motion in that con-
nectiorl, the Judge stated that "the right t o speak and assemble does
not include the right t o do so in public unobierved."
Be&lnning in the afternoon of 2 Octo-,
the prosecution concen-
trated on Jerry Rubin's actions i n Chicago'during the demonstrations,
and an undercover pollce sergeant testified t h a t on the evening of

eleven policemen was tqdng t o keep the people from usiog the park;
shouted, "Let's get these (obscenities) out of here"; R

cigarette toward the police, af'ter which the crowd began thrating cens,
rocks, sticks, etc.
On the next evening, accordin& t o tlre witness,
Rubin told g large group in the p r k , "The pigs started the violence
fight them"; shouted, "They have guns and sticks so we have t o arm
a group of ebaut two hundred persons gathered i n Lincoln Park t o at-
tend a demonstration,on "how t o fight the pip". Abbie Hoffmao demon-
strated a series of motions with hands and knees: & Rubin later re-
mindcd those i n the park not t o forget the gigantic love-in planned
for the beach that night. The police sergeant further testified that
he overheard an identified man (sic) say t o Rubin, Vow is the time
for the flares and the fires"; and that Rubin at first dis-eed,
but
mer the man noted that nothing YBO happening, annrered, "OK, go
get them."
Rubin was also quoted as shouting at the police:
"your
children are pigs.
You're pigs...take
off your guns and w e ' l l fight
but tonight the people aren't going t o give up the park...we
have t o
ourselves vith rocks, sticks, and everything we can get"; and asked
