I had several conversations with of the
Bombing Unit of the Bureau (Tel. 175-46 coucerning their
memorandum of May 8, 1975. I explained t that the
request seemed somewhat unusual to us because it was not handled
as a Freedam of Information Act request and that it would appear

to be as much a Bureau decision as anyone else's whether to
divulge the contents.of the reports. I also stated that the
underlying letterhead memorandum from Birmingham seemed to
indicate that disclosure would jeopardize present Bureau sources,
and that we were in no position to make a judgment on that ques-'
tion. Accordingly, I called to seek their opinion as to what
decision they expected on disclosure.
GED checked with the SAC in Birminsham and informed me
subsequently that the SAC felt the recuest by State Attorney
General Baxley was not made in gocd faith and that they were
not particularly enthusiastic about furnishing the information.

We agreed that Baxley hed been responded to by the SAC
and teld that the reports would not be ferthccming and thet he
should take the watter up with the Civil Rights Division. Bexley
has not done so. We agr ced not to send a written res sponse but
to file the request. We further agreed that if Baxley renewed
his reruest either to us or to the Bureau we would authorize an
oral briefing as to the contents of the statements, thus pre-
serving any parts deemed to be confidential.
