Even after Smith's marriage to Marshall's father
(Marshall II), Marshall still visited his father twice a week for
several days at time. Marshall never saw Smith at Marshall II's
house. It appeared to Marshall that Smith had moved into his old
room at Marshall II's home but did not spend too much time at the
house. Marshall II told Marshall that he rarely saw her at the
house, and that she spent some of her time in California. Marshall
II's caretakers, who live at with Marshall II at his house,
verified Marshall II's statement that Smith rarely spent time with
him. Marshall II expressed to Marshall that he was very upset at
his new wife's (Smith) constant absence from the home.
Marshall II's
kept a log of Smith's visits to
arsha s house. According to log, Smith had
visited Marshall II about a thirty days out of the whole time they
had been married, a little over a year. _Marshall said that if
Smith visited his father for two hours, would log that as
a day she had come to visit. The last mon fe arshall II's
life, Smith never came to see him. Smith's last visit to see
Marshall II was on July 4, 1995. Marshall II died in August 1995.
Marshall II complained to Marshall that Smith asked for
fifty to sixty thousand dollars two times a week. Marshall II
accommodate Smith by borrowing money from the Marshall Family Trust
of which Marshall was the trustee to give Smith the money she
wanted. Marshall II had bought Smith a house in Spring, Texas and
listed under the name of, Houston Land Trust.
After Marshall II's death, a series of law suits took
place between Marshall and Smith. Smith contended that Marshall II
had made her an oral promise to give her half of his estate which
is being held in a family trust. Marshall disputed her claim which
is the subject of a pending civil suit.
The above civil action received notoriety through the
media. Smith had made several comments about the law suit to the
press, and, according to Marshall, she and her two attorney's, had
launched a negative media attack against Marshall. Marshall sued
Smith and her two attorneys. One of Smith's attorneys settled the
civil suit out of court while the other attorney lost several
million dollars as a result of a jury judgment. Smith's suit is
still pending and has been consolidated with the law suit
concerning the Marshall Family Trust.
