AT 7A-1835 PROSECUTIVE STATUS: 1. On May 28, 1981, Fulton County Superior Court Judge, John Langford was presented facts to support an affidavit for a warrant permitting the attachment of a Directional Radio Beacon (BEEPER) to a 1970 white Chevrolet station wagon, bearing Georgia tag LLM 866. Judge Langford issued the warrant and the beeper was subsequently placed on the vehicle. On May 30, 1981, Judge Langford was again presented facts to support an affidavit for a warrant to install a micro- phone and radio transmitter in a 1970 Chevrolet station wagon. Judge Langford issued the warrant on the same date. On June 3, 1981, Judge Langford issued search warrants for the person of Wayne Williams, the 1970 Chevrolet and Williams’ residence at 1917 Penelope Road, Atlanta, Georgia. Gordon Miller, Assistant to Lewis Slaton, Fulton County District Attorney, Atlanta, Georgia, was present at the Atlanta Division on 6/3/81 and was advised of all investi- gation to that date pertaining to Williams, and of the outcome of a polygraph examination administered to Williams on that date. He consulted with District Attorney Slaton and advised that Slaton was of the opinion that there was not enough concrete evidence to arrest or prosecute Williams. Assistant United States Attorneys (AUSA's) Craig Gillen and Charles S. Saphos were also present during entire time Williams was in office and advised it was their opinion that there was sufficient evidence to arrest Williams, in that the investigation to date warranted presentation of facts to a Grand Jury.
