' Reference is made to Bureau letter dated May 22, 1943 (190+190707)
_ in the above entitled matter, instructing this office to present the facts in
instant case to the United States Attorney at Los angeles for his opinion as
to whether or not subject shewld be apprehended as a dangerous alier. enery.
Referenced letter requested that the Bureau be immediately advised regardinc
the details of ths opinion of the United States Attorney in orcer thet the
case mizht be promptly followed up with the Department at the Jcat of Sovernment.
The facte ir. this case, as set out in the re, (Orts of Sooctel agent
Ins ingeles, dated Larch 6, 1943, Mare: 35, 1943, and dine
» 1943, were presented to Assistant United States éttorrey ATTiLIO dicIRcLane
on June 14, 1943, upon his return to duty after a trip to Washinzten, iL. C.
On the basis of the above mentioned reports, together with a translation of 4
play written by subject, know asDie Massnahme", which h23 also heen furnished
to the Bureau, Assistant United States attorney diGInCLa!O decided to lar the
question of sut‘ect's apprehension before the llepartvent withent pakir- any
definite recommendations.
In submittine copies of the above menticne? reports and trans=-
lation to the Department, the United States attorney at Les ..: cles acvised
the Department that subject, an alien enemy, appeared to he 4 proletarian,
bordering on an anarchist, who, in his play “Die Hassenahme”, expounded "Com- i
munism of the Soviet Kussian ideology". The United States attorney wert on
3 to state that subject is opposed to capitalism in any form; that he acvocates
. 4 extrem violence to further the Communist cause as a whole rather than to
relieve oppressed peoples. It therefore appeared that sutject right be apprehende’
in time of war on the grounds that he is an alien enemy whos. activities are dan-
