who subpoenaed the Forsyth County Sheriff, the Chief of Police
of the Winston-Salem Police Department, the Forsyth County -
Solicitor, and Resident Agent DAVID B. MARTIN as defense witnesses.
The three defendants were being tried for charges stemming from
the theft of a meat truck in Winston-Salem, N. C., which was
found parked in front of what was then BPP Headquarters during
January, 1971. When police attempted to search the BPP Head-
quarters, a shootout ensued resulting in assault and theft
charges being filed against the three BPP members. Defense
attorneys filed numerous pre-trial motions, including a motion
to quash the indictments because the Forsyth County jury list
did not contain 18-year olds and did not contain sufficient
percentage of blacks. After one full week of hearings, Superior
Court Judge JAMES M. LONG ruled in favor of the defense and
quashed the indictments against all three defendants. The
Superior Court Solicitor for Winston-Salem, N. C., has advised
he is filing an appeal of Judge JAMES M. LONG's ruling in view
of the numerous problems in reconstituting a jury selection
system of Forsyth County.

BPP members have continued their efforts to raise bond
money for the remaining three of the "High Point Four" who are
still in jail in lieu of bond. They have been unsuccessful to
date in raising sufficient money to bond out anyone of the other
three,
There was very little activity at BPP Headquarters,
Winston-Salem, N. C., during September, 1971, however, the
leaders were tied up in pre-trial conferences with their
attorneys and their court appearances. It is noted that the
BPP members who appeared in the courtroom during the above trial
were very well-dressed and well-behaved, apparently in carrying
out their new peaceful image. There has been no confrontation
by the BPP and police during the past month.
