Captain We We WHITE, Beverly Hills, Police Department, ALLEN SMILEY, a JERI MASON, ‘and CHARLES HILL testified. : Captain WHITE testified that the killing happened at approximately 10:50 Pele on June 20, 197 and he arrived at the residence at approxivately 11:00 PeM.e He stated that he had picked up nine 30-caliber U. S. army carbine shells at the scene; that two shots entered SIEGELtS head, one entering the right eye and exiting at the left eye, the other entering the right cheek 7 and exiting the left neck, shattering the neck vertebra, and that the distance from where the victim was shot to the window of the residence was four feet, ALLEN SMILEY identified the body at the inquest and related the activities of JERI MASON, CHARLES HILL, SIEGEL and himself before the shooting. He stated that at 3:00 P.M. he drove SIEGEL to JERRY ROTHCHILD's Barber Shop, 222 South Beverly Drive, Beverly Hills, California, where he left SIEGEL. SMILEY returned to his apartment and made an appointment to see his doctor. SMILEY completed the appointment which lasted forty-five minutes, and returned — to pick up SIEGEL at JOE ROSS's law offices in Beverly Hills, California, and returned with SISCEL to the Linden Drive address, SMILEY, SINGEL, HILL and MASON then proceeded to Jack's Cafe at Ocean Park, California because they had heard that the cafe had just cnented and all of them were curious to see what it was Like. SMILEY related that after having dinner at Jack's Cafe they returned to the Linden n Drive address and the only stop made was at the Beverly Wlilzlire Drag Tiere whe i TIT L poo checrd sont carphey. The arrived at the Linden Drive address at approximately 10: OO or 10:20 Pel. and za after being in the house for about ten minutes both SIEGEL and SMTLEY sat on the Chesterfield couch talking while SIEGEL Iccked over the Los Ar-veles Examiner newspaper.
