Judge CONGER deferred decision on defendantst motion for an order directing pretrial subpoena of documents preseuted to Grand Jury or to be introduced at trial until 2/4/52 when he directed the Government so furnish defendants for inspection within twenty days before tiial all Grand Jury exnivits and all books and documents to be introduced by Government at telal except such as would disalose identity of informants, On 3/12/52 Judge CONGER ordered the Government to make aval'.able to the defendants within twenty days Defore trial the exeet documentary a exhibits int:soduced before the Grand Jury and to specify sich. articles in magazines, news- papers and other periodicals the Government iatended to Introduce at the trial but that the Government need not specify the exact portions of books and pamphlets it intended to intro- duce at the trial. On 3/13/52 Judge CONGER ordered sealed for the trial judge a list of Government cxhibits to be introduced at the trial which would disclose the identity of informants 1f made available to the defendants. Trial began 3/31/52 before EDWARD J. DINOCK, N.J. A hearing on defendants! jury challenge bean 1/2/52 and ended 4/15/52 when challenge dismissed and defendantst motion for ninety day continuance denied. During hearing defendants called two witnesses and the Govern- ment one. Impanelling of jury began 4/15/52 and completed 4/23/53. Government began presentation of case 4/28/52 and rested 9/5/52 after presenting ten witnesses. Juror CEARLES CHATTERTON excused for illness 8/1/52 and was replaced by Alternate Juror NOBLE L. JONES. Motions for judgements of acquittal granted as to defendants BEGUN end GERSON but ” Lo.
