hemming to clarify Chief Judge Fairchild’s position is

. Lastly, the amount of time and snergy expended on
this case by all concarmed necessitates a complete review of
the Court of Appeals decision all the way to the U.S. Suprens
Court in order to prevent another complex trial which in the
words of Judge Pell would be a miscarriage of justice and a
misuse of the Pederal Judicial facilities. .
