Having been so busy with every- thing, I just couldn't get around to answering sooner. And, of course, I wanted to mail you a copy of my transcript. I finally got it torether; you will find the same enclosed herewith. You may keep this for your personal file, since I have additional copies. Liichigan Supre:e Court refused to review the case. Ky motion for leave to appeal was denied, and I au now preparing to arpeal the case to the United States Surreme Court. My first motion {n the highest tribunal shall be a motion for leave to appeal. Since XY should like to bring 1: the facts, I an attem-ting to perfect a general appeal rather than sec} a review by writ. of certiorari. However, the court under the statute you know has the right to revert to certiorari. With the arplication for leave to appeal I an intendinr to send up a certified copy of the entirely complete record. It may rive the court incentive to per= pend the new evidence which, if presented on a retrial of the cause, would effect my acquittsel. - Iam particularly ‘nterested in having you read the con- fession made by Ed in the case, wherein which confession he names his confederates nnd exonerates me. Also you should read the *“estimony in Error” in which Ed points out how the bankers mis- takeningely identified me for Fisher.
