_« As indicated in retel a group called Green Peace, 3171 ¥
North Halsted Street, Chicago, called a press conference on
January 29, 1982, at which time the group claimed it had fired
flares near the Zion Nuclear Facility in Zion, Illinois, on the
5 evening of January 27, 1982. The flare incident had been
5 videotaped by Green Peace who dropped copies of said tapes
§ at various Chicago news media during the early morning of.
p January 28, 1982. The unclaimed videotapes suggested that
someone planned to attack the Zion facility. During the press
conference Green Peace representatives claimed that they only
fired the flares near the facility to demonstrate the vulner-
ability of theplant in case of terrorist attack.

As indicated in retel, a review of federal statutes
by the Chicago Division and by AUSA Jeremy Margolis, Deputy
Chief, Special Prosecutions Section, USA Office, Chicago,
- failed to reflect a federal violation in this matter insofar
as no Clear threat had been made against the plant and peteuse.

facts in captioned matter and had come to the conclusion that
