COMMENTARY
The SLA is not an army in the military sense. We are able to
acknowledge no more than that they are a guerrilla organization and to
- accord them any type of official recognition tends to remove the onus from
their illegal activity. They are a bargaining bree only because they hold
a hostage. Any agreements made are through duress because of the threat ,
to the life of the victim. An agreement made under such circumstances
would neither be legally nor morally binding.
Obviously, demands for amnésty or pardon for prisoners either.
State or Federal custody are not within the power of the FBI to grant. The
Governor of California has already indicated he would not consider releasing
the two SLA prisoners and undoubtedly no other jurisdiction would succumb |
to such demands. Should we reach the point where the FBI's recommendation
is requested regarding demands for release of prisoners, our position must
be against such release. To succumb in this instance would be precedent _
setting opening the door to terrorist tactics, kidnaping, and hostage situations
whenever any radical group desired release of other prisoners. On the same
basis we cannot recommend amnesty for military deserters and selective
service violators in return for the release of the victim since this would open
the door again to such tactics being used whenever a desperate minority
seeks any goal they desire.
