SUENAGA advised that during the evening of February 4, 1974, at approximately 9:30 p.m., he was leaving his Benvenue apartment to visit a girl friend who lives nearby, and that as he left the front door of his apartment, he was stopped by a Negro male who.was holding a rifle and who was standing near the front of apartment four of his apartment complex. He recalled that the Negro was standing in the shadows, and that it was very dark in the area, and that he did not dbserve the Negro, and that he did not observe the person holding the rifle SO as to provide a physical description. The Negro he said directed that he, SUENAGA, turn around, enter apartment four, . and lie face down on the floor of the entrance way to the . apartment. He said he did as directed and layed down next to STEVEN WEED who was already on the floor of the entrance way. SUENAGA stated he never saw any of the people in the apartment and could not identify any of those persons. He stated that from: their voices, however, thermust have been, in addition to PAT HEARST and STEVEN WEED, two Negro males . and one female, possibly Caucasian. He recalled that he heard voices coming from the kitchen of the apartment, and that one of the Negroes told the female to tie him (SUENAGA) up. fhe female then told SUENAGA to put his hands behind his back, and the female tied his hands and feet with rope. He stated that he continued'to lie face down on the floor, and during the period, did not hear any names mentioned nor did the group make mention to any of their intentions upon leaving the apartment. . _ SUENAGA stated that one Negro in the group asked where the safe was in the apartment, and that STEVEN WEED stated TE 2/5/74 Berkeley, California Fiieg.
