Kings County, witnessed a CP Independent Nominating Petition, pages 1564 and 1565, for BENJAMIN J. DAVIS for the office of City Councilman, Twenty-first Senatorial District, Borough of Manhattan, for the November, 1949 elections in the City of New York, Mr, THOMAS E. WAGGAMAN, Marshal of the Supreme Court of the United States, made available around October 1950 correspondence addressed to the Supreme Court urging that the Court review the case of "The Trial of the Eleven.” One ‘of these pieces of correspondence was a letter post marked August 18, 1950 and dated August 15, 1950, which was addressed to the United States Supreme Court, Washington, D.C. The letter stated,"I respectfully urge you to fulfil the traditional rule of the Court as the watchdog of the Bill of Rights, by revoking the Court of Appeals decision of the 11 Communist Leaders, "Free speech is the cornerstone of a free America and it cannot be preserved unless the Smith Act is declared unconstitutional.
