Black, for it not only didn't _ Adnvestigate hin, but wasn't asked to investigate him, *bhatever the politics followed, the FBI is usually requested by the Attorney Geveral to cake a re- port on the candidates for Federal Judgeships, 0, 5, District Atty: TOYS Ue f. Marsuais, and other similar offices coming under tae Department of Juzricels jurisdiction, This has been a standing pructice for many years but it vould be the height of impertinence for the Departz ent of Justice to blenuly in- vestigate Suprese Court Justices, for the Suprene Court is an indesendint bocy with no comnestion whatsoever with the Departaent 6 of Justice. As ir. Cunrin:s pointed out, no investigations were ever made of any of the present serbers of the Supreme Court with the exception of the Associate Justice\Stone and only then when he waa a candidate for the Attorney Generalship anc not for the Court. Thus, in the light of the facts, 1+ becozes clear thet to blere tne FHI for not presenting the facts of Nr.
