Referring to my report in this matter for April 5-6-7,192

I received the following communication from Mr. Charles
F. Clyne, United States Attorney, Chicago, Illincis, under date of |
April 23rd, 1920, in answer to my communication:
" Replying to your favor of the 12th instant re-
questing information as to the status of tre case in
this district against JOHN A. JOHNSON alias JACK
SUHNSON, as you are aware JUHNSON became a fugitive
from justice after taxing an appeai to the Circuit Scurt
of Appeals from the judgment of the District Court and
nas remained out of the jurisdiction of this court ever
since, The judgment in this district was a sentence of
one year and one day in Leavenworth, Kansas, and a fine
of $1,060. Subsequently after JOHNSON became a fugi-
tive the Cirouit Court of Appeals affirmed this case
and ordered the District Court to resentence JOHNSON
on sexual intercourse counts and retrial on prostitution
counts, which means in effect that he has to appear be-
fore Judge Carpenter, the trial judge, and be resentenced,
I do not desire to enter into any correspondence with 4
the defendant. If he desires to give himself up the d
proper course for him to pursue is to appear before any ‘
United States Marshal and surrender himself. However, I A
have this to say, if he ever returns to the United States, © i
I will at once proceed to have him arrested and brought 3
to the jurisdiction of this Court. " 3
Will convey the above information to JOHNSON and 4
ascertain whether or not he desires to give himself up. :
