Miss B
At this time in response + ay earlier call, Mr. Frank
Coleman in the Department calied an ed with ay
regarding the above captioned case.
He was specifically asked whether a decision had been reached by
relative to the request of Mr. Hallford for advice as to the reply which\ shoul
be given to miners and others interviewed during the course of the Lewis
investigation.
Wr. Colenan stated that the Department's attitude is thet under no circumstances
should copies of statements be given to lawyers. In addition, he stated that it is
the over all opinion of the Department that it would be an undesirable practice
to furnish copies of statements to individuals during the progress of the case.
He stated that, however, where in an individual case it would appear that because
of vital information being in the possession of the person being interviewed it
might be desirable to furnish a copy of the statement, the Department would have
no objection. Mr. Coleman stated he would leave a decision as to that up to SAC
Kaliford as being an "on the spot" decision. .
Mr. Coleman stated that he was leaving today, September 9, 1943, for Springfield,
Illinois, where he planned to spend approximately a week looking toward preparation
of the matter for possible grand jury proceedings. He stated that he would get in
touch with SAC Hallford while there.
WI spac ticay asked Mr. Coleman if the Department had any objection
o the eau Agents referring requests for copies of statements to the
Department, that is, in the following manner. In the event a person being
interviewed requeats a copy of any statement to be given or which has been given,
the Agent would advise the individual that his request would be referred to the
office of the Attorney Gneral or to the Criminal Division of the Department of se
Justice for a decision reietive to his or her request. Mr. Coleman agreed with /”
