with the contemt nroceedinge because of the Tacte involved.
When investigating the UM's reovuest for certification of the
Collective Bargsining agent made epproximtely July 30, 1940, CLARK stated
thet he analyzed the membership of both UM!’ and PHY, showing date of hiring,
including ell those employed es of hay 12, 1937, end that he also secured
union menberehip carde from both unions. Fe stated thet in sone cases
individual miners belonged to both unions, and thet it wae his recollection
thet, including transfers, the UNV had a majority.
. CLaRy advieed that the UM had cooperated with him to the fullest
eytent in supplying witnesses and factual date. Fe further atated thet he
hed submitted a complete renort on the results of his inveetigetion to the
Yetionel Labor Relations Borrd at Chicago, as well es verious statements
teken from mine officiels and minere. Fe stated thet his work pepere were
also included in the N.L.R.B. file, presumedly at Chicago, and thet fron
these pavers he could give more detailed information in regard to the stetus
of union menbdership at the time of hie investigetion.
CLaRK eteted definitely thet he wes not connected with the Kine
"5B" matter on hay 12, 1937, and that he had no details in regard to the
disrissal of twelve miners expelled from PW, nor hed he ever taken up the
matter with CARLVELSHOFF, He suggested thet O. S. SLITH, former W.L.R.B.
Field Reletions Eryaminer, Chicago, Illinoie, now Director of the Field
Division in Yeshington, D.C., could give pertinent information in regard
to this,
Ee also advised thet he had not seen a petition signed by menbers
of URW cated between August 18, 1937, and December 15, 1937, He did state,
however, thet RaY ER-UNDSO!, as befere mentioned, had turned over to him
erolication cards of UMW workers in 1940, and thet probably some of these
hed been completed during this period.
CLARE anreared to the writer to be unbiased in his attitude toward
both unions, and it ie believed thet he would make a good witnesa if given
ape
an opportunity to review his renorte and work pavers.
