of the organization of the Pekin Mining Company by UMW in the summer
ge aa SHITH produced his newspaper files whioh gave & en
detailed ount of the events pertaining to thie mine. The mine
foremerly had -been owned by the Grant Brothere and wae under contract
with the Progressive minerse In the summer of 1936 the mine was sold
to Mr. Fred Schaeffer in Pekin, Illinois. Even though the Progressives
hed a eontreast with the former omer, Schaaffer refused to negotiate

with the Progreesive stating that the consract did not bind him and
signed a contract with the UM. He refused to deal with the Frogressive
and to open hie mine until it could be worked with the Ui. Mre
Smith: stated that his organization tried to enforce their contract
but a decision was handed down against them by the Cironit Court Judge.
It wes also found that the Netional Lebor kelations Board had handed
down a ruling stating that whenever a mine changed owners he was not
bounce by the lebor contract executed by the former owner. Mr. SHITH
wae not aware of whether or not SCHAEFFER War gubsidized by by thea UM

during the time that the mine was shut down. Hie charge was wade but
no evidence was ever developed to substantiate it.
Mr. SKITH personally talked to SCHAEFER who stated that he
overated a construction comany, the employees of which had always
been members of the A.F, of L. and that if he cigned up with another
organigzetion he would lose some 1600 A.F. of L. customers in Illinois
and that he would not open a mine exoept under an A.F. of Le union.
At that tire the UM” was still a part of the American Federation of
Lebor, However, eince the expulsion of the UM’ from the A.F. of L.,
Mr. SCHAEFER has never entered into any negotiation with the Progreesives
reletive to signing the contracts with their orgenization which is now
@member of the A.F. of Le
In vier of the fact thet Mr. WILLIAN RYAN, former owner of Mine
A, Springfield, Illinois, had steted thet one ROBERT RONK had possibly
been approached by EDIUNDSON in a situation similar to the Mine B
case Yr. SUITH wee questioned as to any knowledge that he might have
of that situation as he would have jurisdiction as e Board member.
Kr. S*ITH was acquainted with RONK who hed operated mines
and Middel Grove, Illinois. Mr.e SUITH informed taat KONK had never
ed any mine 8 Progreesive. His mines in fact even after
the break in 1932 had opened under UMFK. Hence it eppeared that a
situation such es the Mine B case could never have occurred in mines
owned by RONK.
