that time ELSHOFF wae with some other individual whom he, XANE, did not
know, ELSHOFT at thet time was somewhat intoxicated, which, acoording
to lr. K.NE, accounted for ELSHOFF's lack of judgment and ciscretion in
making those etatemerte. On all other occesions Mr. KaNE stated that
ELSPOFF was very discreet anc tight lipped. In conferencee most of the
talking was done by ELSHOFF's Attorney.
Further reference wee ~ade to the discussion with Kr. KaXE
concerning the advisory opinion from the Labor Bocrd. Ere KANE stated
thet he furniehed thie opinion to LISHOF, te attorney, LEE ENSEL, by
letter anc that he ie certain the ratter_ ceme to ELSHOFI'e attention
because they disoussed it between them in their conferences.

failure to negotiate with the Fil. hre KEAVE's proposed action brought
obout eone investircetion by repreeentetives of the National Labor
Keletion'es Bocrd who ellegecly told ELSHOFF thet unless he negotiated
with Frogressive ha would be lieble for contempt. For e period of time
efter this pressures wee brought to beer, ELSHOFF apperred to be willing
to necotiate with the Progressives, never, however, to the extent of
signing & contrect. Mr. KANE aleo informed thet before ELSHOFF opened

ELSHOFF wee employing UM. in preference to the Progrersivese Mr. KANE
informed that ELSHOFF worked e very clever scheme in this resect. Most
of the men who were amployed at thet time were men who had formerly
worked in a mine orgenized by the Progressives in 1932 which hed shut
down amost immedistely. These men possibly had been out of work for
savercl yeare and were eventuclly offered & job at Mine B. In every
instance the record es produced by ELSHOFF would ehow thet they had been
merbers of the Pz. However, this membership was not current. It dated
beck to 1932.
With reepect to tho dynamite and bombings in Illinois from 1932
to 1937 Mr. KAKE eteted thet there were threa sets of barbers, those
with the Pl., those with the Ut and those with the operetors. Er.
