Dear Sir:
I an enclosing herewith original and four copies of charge
of unfair labor practice by Local Union #54, Progressive Mine Workers
of America, which I wish you would please file.
A copy of this charge, together with a copy of this letter,
is being mailed direct to the National Labor Relations Board in
Washingtone
This charge is not being filed merely for the purpose of
delaying the action of the National Labor Relations Board in other
matters now pending before it. In explanation of our reasons for
filing this charge at this time, we wish to call your attention to
the fact that due to intimidation and assaults on the part of members
of the United Mine Workers, many of the members of the Progressive
Mine Workers of America are even afraid to go to worke Only yestere-
day, sixty-one men failed to go below because of fear of receiving
great bodily injury. Dey after day, great numbers have remained away
from work. In _the representation hearing, and in the oral arguments
fama ~ a
tefore the Soard in Fashington, we took the position that the petition
of the United Mine Workers should be dismissed. We do not wish to be
understood as altering or changing our position. However, if the
Kational Labor Relations Board feels that an election must be held,
may WS suggest that the Regional Director or the Board send to Springe-
field a wholly disinterested representative or agent who has hereto-
_ fore formed no opinion in regard to the merits of the controversy
. for the purpose of investigating the charge herein filled.
May we suggsst that this representative informally call
together all parties, including officials of Mine B Coal Company and
officials of the United Mine Workers, and that he inform all parties
involved that Intimidation and assaults of every kind and character
must be stopped, end the :ffects thereof cease, before an election
is conducted.
