E STATE OF ILLINOIS }8S8 o COUNTY OF SANGAHON ) John HoCann after first being duly sworn on oath deposes and saya that he is the dily elected, qualified and acting Secretary-~Treasurer ~ of District No. 1, Progressive Mine Workers of America; that as such Secretary-Treasurer he kept the minutes of meetings between the repre- sentatives of Mine B Coal Company and of Local Union #54, P.MOW. of Ae Affiant states that during the morths of May, June and “uly, AD 1940 representatives of Mine B Coal Company did meet occasionally for the purpose of negotiating a contract. Affiant states however, that during seid period of time Carl Elshoff, Operator and Principal Owner of the Company frequently and consistently continued and post-= Poned the meetings. Affient states that from “ay 135th until June 13th sald Carl Elshoff postponed meetings with Progressives three times, firet on account of the death of his mohher, 2nd on account of his own Zliness, and third, on account of his wife's illness. Affiant further states that the scheduled meetings of both July Sth and July 6th were postponed by Carl Elshoff. Affiant states that again on July Sth representatives of Local Union #54, met at the designated place for the purpose of negotiating a contract. Elshoff failed to appear. Affiant states that on July 29th, Carl Elshoff attempted to again continue a scheduled but representatives of local Union #54 went to the mine property and submitted definite proposals to the said Carl Elshoff which Elshoff agreed to accept or reject the following day. Affiant states that on July SOth said Carl Elshoff failed to appear at said meeting and failed to sesign any reason or excuse for his feilure to appear and accept or reject the proposition submitted to him the previous day.
