The radio address by Assistant Attorney General ‘Wendell. Berge, inserted
as an extension of remarks by Mr. MeLaug lin.
Mr. Berse discusses the Department's policy toward rorsecution of
seditious utterances and other laws affectinsfree speech, Ys ex

the words used are criminal in themselves - as advocating overthrow
of the Government ~ or unless they create a direct relationshis be- ;
tween the words spoken and a present danger to the Government. Cre
kr. Berge further points out that an anendment to the Sedition Act oe
of 1917 was passed in 1918. which materially broadened the Act. in
berge then cites convictions secured under this amendient, the
reoccurrence of which he strongly disapproves. The amendment has
since been repealed. However, your attention is called to the fact
that on January 9, 1942, a bill ~ H.@. 6340 — to amend the Es>icnaze
ket, 1917, was introduced which contains nearly identical lanmes
aS the amendment passed in 1916. It would appear, tuerefore,
if He, 6340 is enacted, prosecutions thercunder would De broade:s
