On June 16, 1953, Juatice Douglas of the Suprene
Court requested the Rosenberg defense attorneys to subatt
thetr petittone for a stay of execution tn writings On
thte date, Dantel G. Marshall, attorney, Los Angeles, and
Fykxe Farner, attorney, appeared at the Suprene Court and ~
attempted to file petitions for a writ of habeas corpua on
behalf of the Rosenbergs. Their actton in attenpting to

Ftnerty, attorneys for the Rosenbergae These petitions for
@ urtt of habeas corpus were heard by Mr. Justice Douglas

the death sentence ntght be tmposed only upon the recomnenda-
tion of the jury and then only when the defendants were
