Communication waa telephonically had with the Deputy
Wardens at the U. S. Penitentiary, Leavenworth, Faneas, both at |
the dnnex and the main prison and arrangements were there made to
have the prisoners Bailey, Bates and Kelly available for scrutiny
by the witnesses. Those indiviiuals were alao informed of the
confidential nature of the trips ;
When at approximately 12 noon, 10-18-33 the various wit-
nesses began to arrive at the office it was discovered that a noon
edition of the Kanses City Journal-Post carried an article regard-
ing the intended trip with the witnesses in question. It is anti-
cipated that further comment anil a copy of the article will be
sent by the Special Agent in Charge to the Division.
Acting Speciel agent in Charge M. C. Spear ccomuni cated
telephonically with the Director at i P.-il. advising of the appear-
ance of the newspeper article. The witnesses were still] being held
at the office awaiting further decision as to whether or not the
trip should be made, at the time that communication was had with
the Director. Acting Special Agent in Charge Spear advised the
writer that in view of the publicity which had occurred the Director
had inatructed that the trip be postponed, Mr. Spear therefore ad-
vised the witnesses accordingly. Immediate communication was also
had at that time with the Deputy Wardens, F. J. Morrison of the
main penitentiary and Hudspeth of the Penitentiary Annex, Leavenworth,
Kansas, edvieing them of the postponement of the trip in question.
Under ordere from the Director the various witnesses wil] be taken
in small groups of two and three at a time to the penitentiary to —
view the prisoners in question, Thie action will be instituted at |
en early date ae it was not deemed advisable to take any of them
on the afternoon of 10-18-33, in view of the fact that there would
probably heave been several newspaper cameres ewaiting taking a
photograph of the witnesses.
- It may be etated that arrangements were perfected with
the penitentiary authorities on 10-18-35 to have these prisoners
aveileble for ecrutiny since it was learned that through the
Director of Prisons instructions were received that same should be
done. This arrangement was brought about through the Director of
this Division at the request of Special agent in ChargeConroy. Also
