The question of, obteining process against Lawrenceg3i dderman and an attorney, BerjamingFeldman, as conspirators in harbor and conspiracy to harbor end conceal Verne Miller, was taken up with United States Attorney Green today. It was desired to obtain authorization to proceed against Feldman, because we believe that Feldman mey be in cone tact with Miller in order to arrange bond for Vivian. It is realized thet we de not have a particulerly strong case against Feldman, but we do believe that we have sufficient information so that if authorized by the United States Attorney, we can pick Feldman up erd make him talk under the threat of prosecuting him. This question was discussed in detail with United States Attorney Green and his assiatant, Mr. Canady, and tf. Green stated that before he would authorize any process against Feldman, he desired to take the matter up with the Department at Hashing ton. I am, therefore, enclosing herewith two copies of a memorandum of W. Carter Baum, dated November 6, 1933, setting forth what infoma- tion we have against Feldman and against Lawrence Bidderman, eo that the Division ray be in possession of this information and ine position to talk to the Departuent concerning same when the United States Attorney communicetes tith the Department for the euthorizetion. Pending the above authorizetion, arrangements are being made to place a tap on the telephone of Benjamin Feldman.
