ig nose up. As previously stated, the door to the car had been
opened by Bobbie, and this man with his right hand in his overcoat
pocket stepped into the car, As he was getting into the car, we
noticed Sergeant Frank Freemuth and Special Agent Lou Nichola coming
out of the Galt Street entrance of the apartment building. We also
noticed that ‘both of these men had revolvers in their hands, md just
as Bobbie's car with Verne in it pulled off, we heard agent Nichols
holler something like "*Halt* or "Stop that car*. At that time the
car was practically opposite ‘the car in which we were sitting, going
in an Easterly direction. I immediately opened the right hand door
of this sedan in which we were sitting, and stepped into the street
and leveled the revolver in the direction of the car and shot one time.
Agent Rice, as.I recall, got out of khe back of the car approximately
the same time. By that time agent Nichols and Sergeant Freemuth and
Sergeant Kempster, who had started running in the direction of the
car, had entered the middle of the street behind Bobble Moore's car,
and had opened fire in the direction of the car. It was impossibie
then for Rice or myself to continue fire upon Bobbie's car. Therefore,
no further shots were fired. Cur car was parked between two other cars
possibly 40 feet from where Bobbie Moore had stopped her car in front
of the Galt Street entrance, and our car was beaded in a Westerly
direction. It was impossible, after we became aware of the fect that
they were trying to stop that man, to get back into the car, start it
and get it out from between the two cars and turn it around to an
Easterly direction and give chase to Bobbie's car, for the reason that
by that time they were completely out of sight and nothing could be
done as far as giving pursuit in the car in which we were perked.
We had not received any information that the man in the
room with Vi had been identified aa Verne Niller, and as previously
stated, we had no information that it was known that he was coming
out of the apartment,
