Dr. Irwin efeiavers et al Honorable The Attorney General Weshington, D. C. Sir: 1 . On November 15, 1933, the above naned defendant was arrested by operatives of the Bureeu of Investigation, and held under 310,000 bail by a United States Conu,issioner on a cherge of conspiring with his brother, ‘aberOsilvers, to harbor a fugitive (Verfion.C. #iller). I uncerstand that Dr. Silvers bought optonetrist supplies and had cards printed for Vernon C, iiiller, who — was a fugitive froa Kansas City, wissouri. The nane of Stephen J Gross, Jr., was printed on the letter-heads, prescription blanks and cards. These were ver; obviously intended to be used by the fugitive miller to prove a good alibi for hin in case he was arrested by officers of the law. Since then, however, both the fugitive miller and the co-conspirator Albert Silvers, brother of Dr. Silvers, have died. No good, of course, cen come of the prosecution . for of Dr. Silvers, except punishment for the crime which he hos committed and of course the usual deterrent feature to others who are Likely to conmit the same or other crimes. The case against Dr. Silvers does not see: tc us to be any too strong, and the possibilities of a conviction eccordingly co not sees to be any too likely. Under all the circum Stences in the case, we question whether it would be advisable te proceed any further in the matter.
