—— It was also felt by all present that active efforts should be continued to bring about the apprehension of Wilter Underhill, who is the only other Subject herein, who is under indictment at the present time. A report recently ren- dered by the Oklahoma City office indicates that Underhill is having his automobile serviced at Wetumka, Oklahoma, about once 6 week. Special Agent in Charge Colvin advised that he would proceed to Wetumke personally on December 5, 1933, and make ar- Trangements whereby Underhill's apprehension may be effected at that point. In the event that such agents are needed, an appropriate request will be made of the Division by telephone, ‘ With reference to the three remaining Subjects of Identification Orders issued in connection with this case, it may be noted that there is no federal process outstanding against Charles arthur(Pretty Boy)Ployd; ra%pavis end Rernard‘Phillips. The Identification Order was issued against Floyd inasmuch as he was reported to have been seen at the Union Station in the lobby before the massacre. The Identification Order was issued against Davis in view of the fact that he was one of the participants in the Memorial Day break from the Eansas State Penitentiary at Lan=- sing, Kansas, with Harvey Bailey, Wilber“inderhill, BobCBrady, Jim ‘tlark and others, The Identification Order was issued against Bernard Phillips in view of his close associations in the past with Vernon C. Miller and others. Of course, this office is con- tinuing its activity to bring about the apprehension of Floyd, Davis and Phillips. However, special emphasis is being laid on the apprehension of Galateas and Underhill. In connection with the questicn of bringing about -the apprehension of Floyd, Special agent in Charge Colvin raiaed the question that there was no federal process outetanding against — him, and that any federal officers who effected his arrest would not be sufficiently protected, especially in the event that it should become necessary to kill Ployd in order to take him in custody.
