She further stated that Smalley,” after the killing of Underhill, teld her that he did not know Unierhill anf had never . seen hin and expressed eurprise at Underhill 1 being on | the Premises et hens West A tre " ae * te ERs. “S pees 4. : ' Joe Smalley wes located at his hone, ‘gis viaiand Street, Shawnee, and minutely questioned by the writer, His statements in substance were that he had known Elmer Inman for many years, knew that he had been in prison and had a bad record; that he met Inman at Shawnee on the streets, entered into conversation with bin and Inman told him that he haé quit hie “rackets” and was going streigeht: that he desired to get in some business at Shawnee and make that Place his hore and wanted to rent a furnished house where he could live economically; that Inmen introduced hit to one Sulliwan, whose true name he later learned was Ralph Rowe; that Inman steted that be had received a Court order et Denison, Texus changing his name from Inman te Reynolds; this with the view of losing his identity. He stated that he mentioned the premises at 606 Weat Dewey Street as being for rent and talked to Hatler Smith and his wife about renting it; that he introduced Inman under hie assumed name of Reynolds and Rowe under the essumed name of Sullivan, which he at thet time thought wes hia correct name; that Rowe intro- duced him to a woman as his wife and that they rented the premises in question. Smalley stated that frequently after they moved into the premises Imman and Rowe would invite him to beve a drink with them and that he would join them at 606 West Dewey and drink with them anc that they usually had good whiskey; thet he "never saw anyone at the premises except Inman, Rowe end Rowe's alleged wife; thet sometime about two weeks prior to Underhill being killed, Iman told him that he head received informtion that a request had been made at the McAlester State Penitentiary by the Shawnee Police for his photograph and that he was - afraid they would pick him up on a charge at Ardmore of reckless driving while drunk and that he was "taking out"; that Inman left and he did not sgrin aee him at Shawnee prior to the shooting of Underdill; that arter his departure. bee sav little of Rowe. He stated thet his acts in introducing Inman as Reynolds and aiding him in securing the premiacs at 606 West Dewey were due to a desire to help him go etraight, ae he had expresse: a desire in that respect; that be has known him for many yeers end that be bas a personality that ise very convincing; that he now realizes that he made a erave mistake in interesting himself in Inman's behalf. On a recent date the writer and numerous other witnesses were called tc Shawnee for a preliminary hearing scheduled by the state on a pending charge eralnst Inman for harboring Underhill. On our arrival at Shawnee we were advised by the County Attorney that he hed agreed to an indefinite continuance of the cate
