Department of Justice re-opened the inv¢stigation concerning
the circunstances ‘relating to fie shooting at Kent State
University (KSU) on 5/4/70. Thereafter, indictments were
sought and obtained via a FGJ, and eight sujeots were
thereafter brought to trial in USDC, CV, Onid, 10/74.
In 8/73, the Civil Rights tnvgoti of the U.S.
On 11/8/74, at the conclusion of tha ptosentation
of the Governvent's enaso, the dovense counsel sought and
obtained from Chief Judge FRANK J, BATTISTI a directed
verdict of acquittal of all charges against all cight subjects
based upon the Chief Judge's contention that the Governmont
had not sufficiently exhibited willful intent on the part
of subjects to deprive the victims of their civil rieotel
