Cn September 26, 1967, Assistant Prosecutor
SCARDUZIO recontacted SA PHILIP J. CARROLL and advised
that he is willing in any manner to offer assistance to
the Federal Government in order to have LIVEZLY committed.
SCARNDUZIO advised that a review of the New Jersey State .
Statutes and the criminal code for Camden County, New Jersey
does not give his office any jurisdiction to move against
LIVEZLY, as the mailing of the extortion letters in this
case involve a Federal violation and not a local violation.
SCARDUAIO advised that as there is no local
criminal violation, his office is unable to take any
action against LIVEZLY. Se pointed out none of the Victims
reside in Camden County.
Mz. SCARDUZIO advised that the only action
available locally would be for one of the individuals
whose names were used on the letters sent by LIVEZLY to
come in and sign a complaint against LIVEZLY for Defama~
tion of Character. SCARDUZIO advised that this is a
civil tort action and under this type of action, it would
not be possible for Camden County authorities to oder
LIVEZLY to be given a mental examination.
The matter would be handled in civil court to
determine the amount of damage to the character of the
complainant as the result of the letter or letters, and
if LIVEZLY were ccaivicted, he wouk@ be given a fine by
the court.

[ Fadio Corporation of America (RGA),
amden, New Jersey, advised that the company doctor has
recommended that LIVEZLY be givenan examination by a
private psychiatrist mid for by the company to determine
his sanity.
[_avisea that this has been proposed
to the company union and they are in agreement that this
be done. The union has suggested to LIVEZLY that he con-
sent to the examination by a private physician paid for
by RCA, Camden, New Jersey.
