Of The Herald Tribune Staff On Monday, Feb. 28, Tal- ‘madge Hayer, 24, took the ‘witness stand in Supreme : Court to tell a jury of nine ;meéen and three women that he fired bullets from 27°45 ' caliber pistal into Mateolm’ x last year int the “Audubon Balircom. Yesterday, seven days later, Peter L. F. Sabbatino, Hayer’s attorney, spent three hours telling the same jury that his client was not guilty. “Stay in this jury room until heil freezes over, rather than convict this boy, no mat- ter what he says,” Mr. Sabba- - tinc commanded the jury in | the course of his summation. Mr. Sabbatino maintained that Malcolm was the victim of a vast conspiracy, which in- cluded many of those present for the rally at which he was assassinated on Feb. 21, 1968. Among those he charged as being involved in the con- ‘ spiracy were Malcolm’s se- : curity guards, several prosecu- | tion witnesses and a part-time reporter for Radio Station WAEC, who was covering the rally. He. indicated ‘that the weight of “rigged evidence” had persuaded his client to confess and to attempt to ab- solve his two co-defendants Norman 3X Butler, 27, and Thomas 15X Johnson, both Yeutenants in the Muslims’ Mosque No. 7, of which Malcolm was minister before he was suspended in 1963. Both Charles T. Beavers, at- torney for Johnson, and Wil- liam ©. Chance, attorney for Butler, pointed out “dncon- sistencies” in the evidence and urged the jury to disregard implications that the Black Muslims were responsible for Malcolm's assassination.
