HOGAN uo a ae OBSERVATIONS : ; | OS At the time these flyers initially appeared, consider- ation was afforded to pursuing this matter under Public Law... 670, Title 18, USC, Section 709, which precludes the use of the name Federal Bureau of Investigation or the initials FBI from commercial exploitation. However, we have no firm idea as to who prepared these flyers. With the exception of the name "Feminist Bureau of Investigation," it contains no other identifying data. Inquiries would have to be made of NOW in order to determine the persons responsible. This could easily result in adverse publicity for the Bureau and the Director by either NOW or the Feminist Bureau of Investigation, or both. Therefore, it is suggested the Washington Field office present this matter at this time to the USA to determine if they would consider prosecution under Public Law 670 if we determine the persons responsible. In the event the USA declines, we will be in a position of advising Congressman Hogan that the poster, in the opinion of the USA, does not lend itself to potential successful prosecution. In the event the USA's Office feels it is a violation worthy of pursuing, we will have our New York Office make discreet inquiries in an attempt to identify the persons responsible for these posters and providing them with copies of Public Law 670, in an attempt to have them desist from future occurrences of this nature, as we have with similar matters in the past. In that event, we will be able to advise Congressman Hogan through the Congres~ sional Services Office of contact with the USA and our subsequent efforts in New York. It is pertinent that we withhold making inquiries into this matter until we have obtained an opinion from the USA, since historically successful court action ynder Public Law 670 has been extremely rare.
