and that he last gaw Hemry Roan alive om Jamary £3,

Will testify thet she was guardian for Henry Rom
Prior to and at the time of his death,
Testified that he mt \. K. Hale in Pavhuska, Okla.,
iu the year 192) and inquired of Hale as to names of
Indians on the lives of whom he might write life in-
@ureacce, telling Hale that he had been talking to
Hemry Koen, but dia not know thet Roan gauld procure
a policy, when Reale said, What Honry Roan?* Hele
then reaerked, "I will take that bet, and pay the
premiwa, end make it paysble to me." An epplication
wes mde for a policy on Henry Poan's life, but was
declined. Mr. MeClain will further testify that tw
er three months inter Hale called MeClain over long
distance at Tulas, and said: "Thet fellow has pot
that polisy; I Want you to come up and pess on thet
policy before I accept it”. That a short time there-
efter MeClain met Hale end Mr. Reynolds at the Duncan
Hotel, Pawhuska, amd told Hale be wuld not pasa on the
poliay unless le, Reynolds was present. Hele then celled
ur. Reynolds over end seid, “Here he is". MoClain then
examined the policy and told Hele thet the angwers to
the questions in the application were faleely etated,
and thet he knew Henry Roan was turned down; thet he
(MeClain) examined the policy at the time end san it wos
in the amunt of $25,000. payable to K. K. Hale, md
issued by the Capitel Life Insurances Cc. of Denver,
