On 11/11/54 subject advised the Passport Office
that be was going to seek judicial relief unless a passport
was gives to bin,
On 12/14/54 the Passport Office advised subject
that since he had not furnished an affidavit as outlined
in the Passport Regulations under Section §1.142, he could
etiil ask for a hearing in regards to his request for a
passport.
The file reflected that on 1/13/55 the eubject
dustituted a Civil Action 169-35 in the United States District
Court for the District of Columbia against the Secretary
of State JOHN FOSTER DULLES in an attempt to obtain permission
for the subject to travel in countries of the Western
Hemisphere for which no passport was required for erican
sitizens. His attorneys were JAMES TTYWRIGHT, oe 42th

The file reflected that the case in the J. 5.
District Court was dismissed at a later‘date and that a
suumary judgment for the Secretary of State was granted. The
file indicated that on 6/7/56 the U. S. Court of Appeals
for the District of Columbia affirmed the judgment of the
District Court. Oo 11/5/56 the Supreme Court of the United
States denied the subject a certiorari. ’
The passport File reflected a letter dated 5/10/55
frow LEGNARD B,. BOUDIN to the Department of State advising
that subject bad received numerous requests from all parts
of the world to appear in concerts, in films, and in
plays and had recently received an invitation to appear ia
a film version of “Othello” to be produced in the Soviet
Pnion. He asked the Passport Office to advise whether a
passport could be issued to the subject in order that he
could appear in the fils.
By letter dated 5/25/55 the Passport Office advised
BOUDIN that if the subject desired the Passport Office to
consider the matter of issuing an American passport to the
subject, the subject should withdraw the court action and
submit an affidavit of the nature outlined in Section 51.142
of the Passport Regulations. He was furthermore advised that
subject could request a hearing as provided in the Passport
Regulations.
