Attorney General's Office, Eveile J. Younger represented
by Deputy Attorney General Russell Iunergich;
District Attorney's Office represented by Deputy District
Attorney Dinko Bostanich and Special Counsel Thomas Kranz.
For tha next severai weeks, tne various parties, through their
attorneys cf retord, negotiated the test procedures.
In order to revain his independence, Special Counsel Kranz
abstained from actual negotiations although was an observer
throughout, and Déeguty District Attorney Bozanich advocated the
District Attorney's position for the Forthcoming test. Crucial to
the discussicn tnrovighouc these few weeks were the integrity and
utility of the existing exhibits ard the weapon. The heart of the
Bozanich argument was tnat there were substantial questions whether
cr net the Sirhan exhibits had been preserved so that meaningful
data regarding che assassination of Senator Kennedy could be
derivea from any testing at all. Specifically, Bozanich asked the
other attorneys to first ask the court to determine the impact of
the failure of the County Clerk to administer the extraordinary
orders cf the Superior Court (original Judge Alarcon, Judge Walker
and Judge Loring orders) on tne integrity and utility of the Sirhan
exhi bits. Additionaliy, Bozanich felt that other factors, such as
the mere pascags of time, and potential oxidation of the exhibits,
might have an imvacr on the present usefulness and testing of the
Sirhan exhitits.

Integrity of Exhibits
Bozanich was stating a contern of the District Attorney's
Office that cne possivtle result of the test procedure to be adopted
was that the Sirhan exhibits, inandof themselves, were inconclusive
as to the number of guns at the scene cof the Senator's assas-
Sination. Bozanich askid the other attorneys to request that the
court first determine what significance, if any, could be attached
to the conciusions reached in the testing of the Sirhan exhibits.
In other words, the District Attorney's position was that the
public had a rignt to know all of the facts and circumstances sur-
rounding the assassinaticzn of Senator Kennedy, and that this right .
would be frustrated, uniess guidelines were first established, both
as to the significanes cr the test procedures, and to the con-
Clusions that couid be derived from the examination and testing of
the exhivibts. Additionally, Sozanich argued in several preliminary
meetings with the various attorneys that failure of the court to
State specific findings of facts and conclusions of law after the
ballistics examination, might further confuse the public.
