Pursuant to the positive identifications and in conjunction with other evidence, such as the fingerprint of Malvo, the Montgomery Police Department obtained Capital Murder Warrants against Muhammad and Malvo via the 15th Judicial District of Alabama, located in Montgomery, b6 Alabama. bIC Per information obtained from agentL___ C~—C~—CSCsr Bureau of Alcohol, Tobacco, and Firearms, assisting in the "SNIPEMUR" Command Post, Montgomery County, Maryland, ballistic Eragments supplied by the Montgomery Police Department did not match a 22 magnum caliber bullet from a long gun. The fragments were believed to be from the 221 to 227 caliber family but a batch test will be required before any definitive results can be made. In addition, since the government recovered the rifle from the subjects' vehicle, the BATF will conduct further testing to ascertain, without a doubt, if the Montgomery, Alabama, fragments were shot from the sniper rifle. This aspect of the Montgomery, Alabama, case is still pending.
