On October 23, 2002, United States Magistrate Judge Monica J. Benton of the
United States District Court for the Western District of Washington issued an
Asrest Warrant for MUHAMMAD. The warrant was in support of a criminal
complaint charging MUHAMMAD ‘with violating 18 U.S.C. § 922(¢)(8) and
924(a)(2) — (Possession of a Firearm Affecting Commerce by a Person Subject to
An Order of Restraint). ° Also on October 23, 2002, United States Magistrate
Judge Jillyn K. Schulze of the United States District Court for the District of
Maryland (Southem Division) issued a Material Witness Arrest Warrant for
JOHN DOE, JUVENILE.
During the late evening and early morning of October 23 and October 24, 2002,
law enforcement authorities released information to the public that they were
seeking information related to a Chevrolet Caprice which they had discovered
was co-registered in MUHAMMAD’s name. According to information provided
by concemed citizens to police officials, an automobile matching the description
of the Caprice was seen at the shooting in the District of Columbia on October 3,
2002, and at the shooting on October 22, 2002, on Grand Pre Road in Silver
Spring, Maryland.
A short time after releasing the vehicle information, law enforcement received
information from a concerned citizen indicating that an automobile fitting the
description was located at a rest area near Myersville, Maryland. Law
enforcement authorities responded to the scene and observed MUHAMMAD and
JOHN DOE, JUVENILE, asleep in a blue 1990 Chevrolet Caprice, VIN #
1G1BL5472LA141552 (“the Caprice”).
Law Enforcement Officers of the FBI, the Maryland State Police and other
Federal and State Law Enforcement Officers placed MUHAMMAD and JOHN
DOE, JUVENILE, under arrest pursuant to the authority of the arrest warrant and
the material witness arrest warrant described above.
A federal search warrant was secured to-search the vehicle. That search revealed,
among other things, the following items either in or around the Caprice:
A. A single brown cotton glove which was protruding from a hole in
the trunk — the glove appears to be very similar to another single
brown cotton glove found at the scene of the shooting on October
22, 2002, on Grand Pre Road in Silver Spring, Maryland;
B. A Bushmaster model XMI15-E2S .223 caliber rifle, serial number
1284320 (“the rifle”), found behind the rear seat;
4 Because of certain limitations associated with the scope of the warrant not all of the
above items were seized, even if observed. Additional warrants are being secuted to permit
search and seizure of additional items. As of the time of the preparation of this affidavit, aspects
of the car search are still ongoing. Thus, the above list is not intended to be comprehensive.
