ue On page.16 of the attached memorandum, it is pointed
out that the Depuertment of Justice has advised the
Department of Stote that Mr. Hoover never made the widely
publteized statenent that it was a one hundred per cent 4. ¢
airtight case agcinst the Amerasia defendants. This ‘
of course is an incorrect statement and while the Depart-
ment has been advised of the inaccuracy of this, the
Commtttee has not.
On pege <6 of this memorandum, it ts noted that the
- letter from the Director to the State Department with
reference to the chart prepared by Sam Klaus was set
forth in full.
With reference to the Amerasia Case on page 320 of
the attached memorandum, 1% ts set forth that representatives
of the Crimincl Diviston conferred with FEI offictels on
the morning of September 28, 1945, and it was genérally
ogreed that the case was in serious jeopardy. <A number
of suggestions were made and diseccrded. This Jeaves the
erroneous impres:ion that the Bureau might hcve concurred
in the Depcrtment's handling of the prosecution, .
It is pointed out that the full testimony of the
Bureau's representatives is not set forth in the report.
Excerpts from the testimony are mentioned tin the footnotes.
It is noted that the question, which was 7B in the
testimony, was changed. This question ts quoted and reads
"Vas evidence sought and obtained by entering the apartment
and premises of the accused without legal process and with-
out the knowledge of the accused.” Mr, Nichols’ answer
was then quoted.
The next question is worded "Were these entries
of the premises before arrests made by the Agents without
legal process and without the knowledge of the subjects.”
The words surreptitiously” and "“stealthtiy” are not used.
