Dear Mr. Kelley:
A number of persons who have requested or are requesting
information from the Federal Bureau of Investigation under
the Freedom of Information Act have voiced concern over
newsstories suggesting that the Bureau “opens a file" or.
such requesters of information.
While it is obvious that a file would have to ke opened to }
facilitate the processing of a Freedom of information request,
the law clearly places no requirement on a requester to ke
directly or personally concerned with the matter about
which he requests information (except, of course, when one
is requesting access to his own file). Especially cons idex ~
ing the large number of current requests for information
being received by the FBI, it would seem an unnecessary
diversion of attention from processing these requests for
agents even to take time for background checks of requesters.
I would appreciate your explaining the precise procedures
used by the FBI in filling Freedom of Information requests,
including-an indentification of the index, files or other
lists against which the requester's name is checked and
the purpose for such check.
