Congress may freely rule as te who may become citizens of thie
country, and who may not.
A State may properly base its own legislative attitude upon
such ruling. Congress has excluded Japanese, Chinese and Malays from
California's alien land law is not discriminatory on the basis
of race, for it forbids, fron land-ownership or lease, all persons of
whatever race who have not deolared their intention of becoming citizer
Phis, of course, automatically exoludes those peoples who are forbidden
citizenship by act of Congress,
Nor does our State law conflict with the American-Japaness
treaty, since said treaty does not expressly give tne Japanese the
right to own or lease American land,
Finally. to quote from the decision a point repeatedly urged
by the Hearst Newspapers;
"It is obvious that one who is not a citizen, and cannot be-
eome one, Laoke am interest in and the power to effectually work for
the welfare of the state *** If one incapable of oitizenahip may leage
or own real estate, it is within the realm of possibility that every
foot of land within the State might pass to the ownership or possessior
of non-citizens".
