MEMORANDUM FOR MA. TOLSON
MR. BOARD MAN
MR. BELMONT
MR. ROSEN
MR. NBEAS?
Yesterday f attended the Attorney General's staff meeting
presided over by the Attorney Gemeral. The Attorney General opened the
meeting by stating that he was particularly pleased with the decisions
handed down by the Supreme Court on Monday of this week. He was
referring particularly to the Gilbert Green and Heary Winstoa decision
and the Stefeua Brown decision. He stated that he thought that these
decisions indicated that there was a healthy trend developing in the Court
in that Justice Charlies Whittaker, the most newly-appolsted Justice, had
joined with the majority and that Justice Frankfurter had also joined with
the majority and he, the Attorney General, believed there was a possibility
thai Justice Erennan might eventually break away (rom the minority which
holds the more extreme views. Solicitor General Rankin likewise joined
im this view of the Attorney General.
There was alec some discussion by the Attorney General of
the necessity for greater care in the selection of cases to be carried up -
an appeal so thet the strongest possible cases could be presented to the -
Evupreme Court and not weak ones which would enable such Justices as |
Black aad Douglas te make quite om issue of the facta rather than of the law.
