Mohr ~ — De fer 6) Ce! ee a cI lira lps I le arte a i ne SUBJECT: The Congressional Record ee Pages A5380-A5384, Congressman Multer, (D) New York, extended his remarks to include an article by MaxweliBrandwen, member of a prominent New York firm of attorneys, entitled "TheSupreme Court—Current Criticiam in Perspective’ which appeared in the May 24, 1958, issue of the Nation. Mr. Brandwen commented on the attacks against the Supreme Court. He stated, in connection with the Jencks decision, "From the cascade of press comment, one would have supposed that the Court kad announced a startlingly revolutionary doctrine. Quite the contrary. It is an old, well-established rule of law that a party to any Htigation may discredit the testimony of an opposing witness. * * * In the Jencks cage, the Court permitted such examination and comparison. That is the core of its decision.'' The references to the FBI have been noted. Mr. Brandwen went on to state "The Court, at times, undoubtedly has erred. The Congress, at times, has errec, too.
