Mr. Wawnax.. Congressman Dellums, this morning the date I men-
tioned was 1968 as opposed to 1965. I have no knowledge that the
“BI has burglarized the Socialist Workers Party in that or other
instances you are talking about since then.
Mr. Dextoms. You say you have no knowledge. Let me put it this
way: I would like to suggest that you check the files, and if there is
any material leading to any facts that you burglarized the SWP or
its Michigan office. would you supply that in writing to this committee?
Mr. Wanxnart. The files have been checked, and T assure you there
is nothing in the files to indicate that in 1971 the Michigan office was
burglarized. .

FBI manual section 129, entitled “Extremist Matters and Civil
Unrest,” says in part:
To addition to the three principal statutes outlined above, the following statute
would pertain to juvestizations of Klan aud other white hate groups,
(4) Civh Rights Act of 1968 (T18, USC, Sec. 241)
In sununary, this statute makes Jt unlawful for two or more persons to con-
spire to injute, oppress, threaton, or intimidate any citizen In the free exercise
or enjoyment of roy right or privilege secured to him by the Constitution or
laws of the United States. Additionally, ft prohibits two or more persons golng
in disguise on the highway or on the premises of another with intent to prevent
or hinder his free exercise or enjoyment of any rights secured by the Constitn-
tien or the laws of the United States. .
Doesn’t this in fact describe the maior part of the FRVs intelliganse
activities against so-called dissent groups in this country?
_ Mr, Waxxate. The entire matter relating to the so-called Cointelpro
has been reviewed and is under consideration in the Civil Rights Divi-
sion of the Department of Justice. We took our entire file on the
Cointelpro and made it available to the Assistant Attorney General
and two of his deputies to review the matter. While it was not possible
for him to look at every serial, he did Jook at most of the serials, and
in fact Mr. Ryan, who is at the table with me, tried to direct his atten-
tion to specific items that might. be troublesome. -
Following the review, he said based on his review there was no indi-
cation of a violation of the statute. He did say that if any information
is called to his attention in the future, he certainly would consider it.

My point is: Yon say you don’t have it, but don't you in fact still
have those names, and you can call them forward at any timet
Mr. Wanxara. We have cards on 13,000, I will accept that Seure. I
think it is probably in that neighborhood. When the security index
was discontinued by legislation of this Congress in September of 1971,
wo had 8 program of regularly destroying cards. They were main-
tamed for a certain period of time and then destroyed. However, Sena-
tor Mansfield issued instructions in January of this year that no ree-
ords should he destroyed pending the outcome of the investigations b
