William Gardner of the Civil Rights Division and desired to interview

as any and all possible violations of citizens‘ civil rights by FBI Agents
and intended to go back as far as 1940. This was the first indication
we have received that the Department's inquiry is not to be limited
to surreptitious entries.

Assistant Director Leavitt he had been contacted by Gardner concerning
surreptitious entries investigation.

Counsel Division who informed him that he was released from his
employment avreement for the purpose of consulting with private
counsel if he desired to retain san tated that he had retained
counsel and upon his advice had declined to be interviewed by Gardner
at this time.
During the conver sation tated that Gardner
stated he intended to cover the following subjects. The interview
[was to cover all investigative techniques utilized by Squad 43 and the
entire Division 4 of the New York Office. This would include sur-
reptitious entries, wiretappings, COINTELPRO activities, and the
identity of Agents participating in above activities. In addition, Gardner
stated he desired to learn what level of authority approved the above
activities and what levels of authority were aware of such activities
and acquiesced in their being conducted.
