Adams memorandwn to Mr. Mint: 7 b surreptitious Entries ADDENDUM; _LBGAL COUNSEL DIVISION 9/3/76 You are correct in your understanding that there is no legal bar to our taking administrative action against a Special Agent SA! based upon information he reveals after being granted immunity from criminal prosecution by the Department. This assumes, of course, that the facts he dis- closes indicate that he has acted in an unauthorized or other- wise improper manner in connection with his employment. As you note in the attached memorandum, it would be improper to take administrative action against an SA because of the fact of his cooperation and, of course, we would not wish to do so as the Bureau has indicated it desires to have our employees cooperate fully in this matter, consistent with their own Fifth Amendment rights. We concur in the suggestion that your response be cleared through Mr. Pottinger because, as a practical matter, such a response could have the effect of lessening an Agent's willingness to discuss fully and candidly his activities. We certainly wish to avoid any possibility of the Civil Rights Division incorrectly construing our response as an intentional effort to lessen cooperation from our employees in the captioned investigation. / i 3 I I
