Dr. Elizabeth Loftus said many factors contribute to the loss of memory and discrepan- cies which can crop up in a vietim’s recollections of an inci- _ dent after a long time. - -. The attitude of a questioner has an important bearing on - what the witness can remember . about an incident, she said. Defense Attorney John O’Connell asked if there is a. definite effect on a witness in - trying to recall a face if he is shown a great many pictures. “Yes,” the psychologist said. “The more pictures a victim sees,.the more effect there is on his or her retention and the . more chance of failure to cor-, rectly identify a picture.” O’Connell referred to the fact that Miss DaRonch was shown’a great number of pictures as a « suspect for her kidnaping was sought. The psychologist also noted that a person remembers less in a stressful situation than in a non-stressful situation. Dr. Loftus told Judge Hanson that a subject’s original mem- ory of an incident can be - distorted unintentionally by a questioner who ‘‘loads” ques- tions or who by subtle cues sets _ up his own bias in the victim’s - O’Connell asked if this bias might be stronger if the subject sees the questioner as an au- thority figure, and the psychologist answered that it would. “See NOT on B-12
