Hanson Jr. has set Oct. 14 for arguments on whether convicted . kidnaper Theodore M. Bundy will receive a new trial. In a motion filed with the court Aug. 29, Bundy’s Utah attorney, John D. O’Connell, said prosecutors withheld a police report which casts doubt on the identification of Bundy by the kidnap victim, Carol DaRonch, Murray. Bundy, 30, was convicted of kidnaping Miss DaRonch from a shopping miall parking lot Nov. 8, 1974, She was 17 at the time, ; Bundy is in a Colorado jail awaiting trial for the murder of a nurse, Caryn Campbell, 23, Dearborh, Mich., who was killed while attending a convention in Aspen, Colo., in 1975. . Until extradited to Colorado, Bundy had been serving a one-to-15 year sentence in Utah State Prison for kidnaping Miss DaRonch. , O’Connell won return of the kidnaping case to district court after an appeal to the Utah Supreme Court. . . In his motion, O’Connell maintained that a report made by Salt Lake County sheriff's officers regard- ing sessions with Miss DaRonch was withheld. He said the report of the photo-viewing incident _ indicated that the young woman was not sure of tlle identity of the kidnaper. However, she later pickid Bundy out of a police lineup the following month. 1 O’Connel. and Salt Lake Deputy County Atty. David Yocom will present arguments in the case Oct.
