Third District Court Judge Jay E.
Banks ruled Monday convicted kidnap-
per Theodore R. Bundy is not entitled to
a new trial because of a report
allegedly suppressed by lawmen.
Defense attorneys asked for a new.
Lake County sheriff’s office withheld a
report which said the eyewitness
against Bundy was “‘not very good.”
Bundy, 30, was convicted of the
November 1974 abduction of Carol
DaRonch, then 17, from a shopping
‘ trial because they contended the Salt__mall in Murray.

kidnapper. The judge subsequently
sentenced Bundy to serve one to 15
years at Utah State Prison.
In a statement Moriday, Judge Banke
said the action of the sheriffs offic ‘
was “not a willful withholding.”

In response to the defense attorneys’ ;
allegations that his office withheld vital
information, Sheriff’s. Capt. N. D.
Hayward Monday issued a formal

The captain’s response dealt ith -
remarks made by Bundy’s attornt py,
J ohn D. O’Connell.
“Mr. O’Connell,”’ the release says,
“Waid that the sheriff's office had
ccincealed and suppressed evidence,
made false and misleading statements
and had presented perjured testimony
at the trial (of Bundy).”
Regarding his department’s treat-
ment of the Bundy case, Capt. Hayward
wrote: “When Bundy was initially
arrested in August 1975, every effort
was made by this office, the Murray
City Police Department, the Bountiful
City Police Department ‘and the Salt
Lake County attorney’s office to protect ,.
